This comprehensive policy protects Pocketsflow (operated by Pocketsflow, Inc.) from liability related to third party content and products. We maintain strict oversight and zero tolerance for violations while ensuring clear legal separation from third party sellers.
Disclaimer of Third Party Content
Third Party Content and Products. Pocketsflow (“Platform,” “we,” “us,” or “our”) is an online marketplace that allows third party sellers to offer and sell products and services. All content, listings, products, and services offered by third party sellers (“Third Party Content”) are the sole responsibility of the third party sellers who provide them.
No Liability for Third Party Content. We expressly disclaim all liabilities arising from or related to Third Party Content. This includes, but is not limited to, any claims for:
- Product defects or failures
- Inaccurate product descriptions or representations
- Intellectual property infringement
- Personal injury or property damage
- Any other claims related to products or content provided by third parties
Separation of Platform and Sellers. Pocketsflow does not adopt Third Party Content as its own. We do not create, select, modify, or exercise editorial control over Third Party Content. We do not guarantee the accuracy, quality, safety, legality, or availability of any Third Party Content.
Platform Role and Presentation
Clear Identification of Sellers. All products and services offered by third party sellers are clearly identified as such. Pocketsflow takes measures to ensure that a well informed and reasonably observant user can distinguish between products sold directly by Pocketsflow (if any) and those sold by third party sellers.
No Implied Endorsement. Our provision of the Platform for third party sellers does not constitute an endorsement, approval, or warranty of any Third Party Content. The presence of Third Party Content on our Platform does not imply that we have reviewed, approved, or warranted such content.
Limitation of Liability
Scope of Limitation. To the fullest extent permitted by applicable law, Pocketsflow will not be liable for any indirect, consequential, incidental, special, punitive, or exemplary damages arising from or relating to Third Party Content. This includes but is not limited to:
- Loss of profits, revenue, or data
- Business interruption
- Personal injury
- Property damage
- Any other losses
Maximum Liability. In no event shall Pocketsflow’s total liability to you for all claims related to Third Party Content exceed the amount paid by you to Pocketsflow (excluding amounts paid to third party sellers) in the twelve (12) months preceding the event giving rise to the liability.
Indemnification
User Indemnification. You agree to indemnify and hold Pocketsflow harmless from any claims, damages, liabilities, costs, or expenses (including reasonable attorney’s fees) arising from your use of Third Party Content or your interaction with third party sellers on our Platform.
Notice and Takedown Procedures
Reporting Problematic Content. Pocketsflow provides a notice and action mechanism for users to report potentially illegal or harmful Third Party Content. While we are not obligated to monitor Third Party Content, we reserve the right to remove any content that violates our policies or applicable law.
Response to Notices. We will respond to notices of alleged copyright infringement, trademark violations, counterfeit products, or other illegal content in accordance with applicable laws and our internal policies.
Legal Compliance
Evolving Legal Landscape. This disclaimer acknowledges recent legal developments that may affect platform liability, including changes in case law regarding platform responsibility for third party products. Pocketsflow implements reasonable measures to comply with applicable laws while maintaining its status as a marketplace platform rather than a direct seller of third party products.
Digital Services Act Compliance. In accordance with emerging regulations, Pocketsflow takes appropriate measures to ensure that users can clearly distinguish when products are being sold directly by Pocketsflow versus when they are being sold by third party sellers.
Amendments
We may need to update, change, or modify this Third Party Content Liability clause from time to time. Any changes will be effective upon posting the revised clause on our Platform. Your continued use of our Platform following such changes constitutes your acceptance of the revised clause.
Seller Approval and Content Monitoring
Comprehensive Seller Review: All third party sellers undergo thorough approval and continuous monitoring:
- Pre Approval Assessment: Complete evaluation of seller legitimacy and content quality
- Content Verification: All products reviewed for compliance with our standards
- Ongoing Monitoring: Continuous surveillance of seller activities and customer feedback
- Immediate Action Authority: Instant removal of noncompliant content or sellers
- Regular Reevaluation: Periodic reassessment of seller eligibility and performance
